School Admission Appeals
Parents will know that popular schools will always be oversubscribed. This problem will have been made worse by the legal restriction on class size in infant schools. Decisions made by an Admissions Authority or an individual school will be of crucial importance to your child.
Although the vast majority of pupils will be accepted at a school that both they and their parents will be happy with, a significant number will be disappointed. A failure to secure a place at the preferred school may result in acute difficulties for the family, who may face the prospect of a significant journey to school, or have to take siblings to separate schools.
It might be felt that admission authorities discourage representation by and education law solicitor at School Admission Appeals. The process was perhaps not designed with this in mind. Unfortunately, because there is increasing competition for school places it is the case that we are instructed in more and more cases before the independent appeal panel.
We will be able to provide you with advice and representation in relation to all of the potential legal problems that can arise with school admissions. These can include:
- School admission appeals
- School exclusion appeals
- Non-school attendance prosecutions
- Special Educational Needs (SEN) and ECHP’s
- University disciplinary hearings
- Discrimination matters
- Judicial review
If you are faced with any of these problems one of our specialist education lawyers will be able to provide you with an initial opinion to explain the likelihood of success in any given appeal. This will be based on information we take from you at an early stage. This will help you to decide whether you should pursue an appeal.
If you choose to appeal we will be able to help you think about the type of information and arguments that may assist in your case. Additionally we will be able to point you in the direction of any necessary research that you should carry out. Alternatively we can undertake that research for you.
We can guide you as to how best to structure the arguments that will need to be in the appeal statement. Our solicitors can draft the statement for you. An education lawyer will tell you how the school appeal hearings work and what to expect at each stage. You will be able to anticipate questions that you are likely to be asked. Evidence will be provided to support any statements that you make.
If you instruct us to, we will represent you at the appeal hearing in order to make the arguments on your behalf, and help you explain your individual situation to the appeal panel.
We recognise that our clients will wish to choose the level of support that we provide. In many cases we will be able to deal with your case to conclusion by way of an agreed fixed fee. More information about our fees can be found here. [link to our school admission appeals fees]
