School Attendance Orders
Where a Local Authority is not satisfied that a child is receiving suitable education then a School Attendance Order can be served on a parent. This requires the parent to register a child to a named school. The order remains in force while the child remains of compulsory school age unless the Local Authority revokes it. An application can also be made to the Magistrates’ Court to direct that it cease to apply. There can also be negotiations with the Local Authority to change the name of the school by agreement.
A breach of a school attendance order can be prosecuted in the Magistrates’ Court.
