Firearms and Shotgun Certificate Appeals
The police have wide powers to revoke Firearms and Shotgun Certificates and to refuse applications. These decisions can have severe consequences on those involved.
Can I appeal the decision to refuse or revoke my Firearms or Shotgun Certificate?
There is an automatic right to appeal against the police decision and the appeals are heard in the Crown Court. There is a strict 21 day limit to make the appeal – starting on the day of the police decision. It is therefore vital that you obtain expert legal advice without delay.
What happens at the appeal hearing?
The Crown Court judge will hear evidence from both parties – the person making the appeal and the chief officer of police who made the decision being appealed. Witnesses will give evidence and be cross-examined. The chief officer of police can be cross-examined – which makes it important that you are represented by an experienced advocate.
The judge may consider additional evidence that was not available when the initial decision was made.
